Overview

This website is operated by Barehush ("Barehush", "we", "us"). By visiting barehush.com, creating an account, or placing an order, you agree to these Terms of Service and to our Privacy Policy, Refund Policy and Shipping Policy, each of which is part of these terms. If you do not agree, please do not use the site.

We may update these terms from time to time for legal, regulatory or operational reasons. The current version is always posted on this page with the date it took effect. Changes apply to orders placed after they are posted.

Who can order

You must be at least 18 years old, or the age of majority where you live, to place an order. By ordering you confirm that you meet that requirement and that the payment method you use is your own or that you are authorized to use it.

Our products

Barehush garments are everyday compression apparel. They are not medical devices, and they are not intended to diagnose, treat, cure or prevent any condition, to alter body composition, or to produce any health outcome. If you are pregnant, recovering from surgery, or have a circulatory, respiratory, digestive or skin condition, talk to your doctor before wearing compression garments. Stop wearing a garment if it causes pain, numbness, tingling or shortness of breath.

We describe our products as accurately as we can, but colors and textures may render differently on different screens, and measurements are approximate and may vary within normal manufacturing tolerances. Sizing guidance is provided on each product page and in our Size Guide.

Orders, prices and payment

All prices are shown in US dollars. Import duties and taxes are included in the price you see at checkout. Payment is taken at the time you order.

Placing an order is an offer to buy. We accept it when we send you a shipping confirmation. We may refuse or cancel any order, including where a product was listed at an incorrect price, where a product is unavailable, where we suspect fraud or reseller activity, or where we cannot ship to your address. If we cancel an order after payment, you receive a full refund to your original payment method.

Promotional codes cannot be combined unless we say so, have no cash value, and may be withdrawn or expire.

Shipping and risk of loss

Shipping destinations, timelines and costs are set out in our Shipping Policy. Delivery timelines are estimates, not guarantees, and can be affected by customs, carriers and events outside our control.

Risk of loss passes to you when the carrier delivers to the address you provided. Please check your address at checkout — once a parcel has left the warehouse we cannot redirect it.

Returns, exchanges and refunds

Our Refund Policy forms part of these terms. In short: one free size exchange per order within 30 days of delivery, with no need to send the original back; refunds within 30 days require the piece to be unworn — hygiene liner intact on the bodysuits, slip dresses and slip skirt, tags attached on everything else — and returned at your cost to the address we provide. For hygiene reasons, a garment whose liner has been removed is final sale, except where the law says otherwise.

Your account

If you create an account, you are responsible for keeping your login details secure and for activity that happens under your account. Tell us promptly at hello@barehush.com if you believe your account has been used without your permission. We may suspend or close an account that is being misused.

Emails and messages

When you order, we send you transactional messages — order confirmations, shipping updates and service notices. These are part of the purchase and are not marketing.

If you sign up for our list, we send occasional marketing emails. You can unsubscribe at any time using the link in any marketing email, and we will stop. Unsubscribing from marketing does not stop transactional messages about orders you have placed.

Reviews and anything else you post

If you send us a review, photo, comment or other content, you keep ownership of it and you give us a non-exclusive, worldwide, royalty-free licence to use, display, reproduce and adapt it in connection with Barehush, including in marketing, unless you tell us otherwise in writing.

You confirm that the content is yours to share, that it is accurate, and that it does not infringe anyone's rights. Please don't post anything unlawful, misleading, abusive, obscene, or that contains someone else's personal information. We may decline to publish, or remove, any submission, and we are under no obligation to publish anything. We do not pay for submissions unless we have agreed to in advance, and any incentivised review must be disclosed as such.

Acceptable use

Please use the site lawfully. Don't attempt to gain unauthorized access to our systems or data, interfere with the site's operation, scrape or harvest data at scale, introduce malicious code, impersonate anyone, or use the site to infringe anyone's rights. We may restrict or withdraw access if you do.

Intellectual property

All content on this site — text, images, graphics, logos, the Barehush name, and our product designs — belongs to Barehush or its licensors and is protected by intellectual property laws. You may view and share the site for personal, non-commercial purposes. You may not copy, reproduce, modify or use our content or brand commercially without our written permission.

If you believe content on this site infringes your copyright, email hello@barehush.com with a description of the work, the location of the material on our site, your contact details, and a statement that you believe in good faith the use is not authorized. We will review and act promptly, including removing material where appropriate.

Links to other sites

The site may link to third-party websites and services we don't control. We are not responsible for their content, products or practices, and a link is not an endorsement. Their terms and privacy policies apply when you use them.

Errors and omissions

Occasionally information on the site may contain a typographical error, inaccuracy or omission — including in a description, price, promotion, or availability. We may correct such errors and update or cancel affected orders at any time, including after an order has been submitted, and we will tell you if we do.

Disclaimers

Except where the law says otherwise, the site and everything on it are provided "as is" and "as available", without warranties of any kind, whether express or implied. We do not warrant that the site will be uninterrupted, secure or error-free.

Nothing in these terms excludes or limits any warranty, right or remedy that cannot be excluded or limited under the law that applies to you as a consumer.

Limitation of liability

To the fullest extent permitted by law, Barehush is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, arising out of your use of the site or a purchase from us. To the fullest extent permitted by law, our total liability for any claim relating to a purchase is limited to the amount you paid for the product concerned.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law — including consumer rights that apply where you live.

Indemnity

You agree to indemnify Barehush against third-party claims, losses and reasonable costs arising from your breach of these terms, your misuse of the site, or content you submit to us — except to the extent the claim arises from our own act or omission.

Term and termination

These terms apply while you use the site. We may suspend or end your access at any time if you breach them. Sections that by their nature should survive — including intellectual property, disclaimers, limitation of liability, indemnity, dispute resolution and governing law — continue to apply after that.

Resolving a problem

Most problems are quickest to fix directly. Before starting any formal proceeding, please email hello@barehush.com with your order number and what went wrong, and give us 60 days to resolve it. We commit to engaging with you in good faith in that period, and we ask the same.

Nothing in this section prevents either of us from bringing a claim in a small claims court, or from seeking an injunction to protect intellectual property.

Governing law

These terms are governed by the laws of the Hong Kong Special Administrative Region, and the courts of Hong Kong have non-exclusive jurisdiction — meaning we may also enforce these terms where you live, and you may bring a claim in your local courts where the law gives you that right.

This does not deprive you of the protection of mandatory consumer-protection laws of the country or state where you live, and those protections continue to apply.

General

These terms, together with our Privacy, Refund and Shipping policies, are the entire agreement between us about your use of the site. If any provision is found unenforceable, the rest continues to apply. If we don't enforce a provision, that isn't a waiver of it. You may not transfer your rights under these terms; we may transfer ours to a successor in connection with a merger, acquisition or sale of assets. Neither of us is liable for failure to perform caused by events beyond reasonable control, including natural disasters, war, epidemics, carrier failure, customs action and utility or network outages. Headings are for convenience only.
